Terms of Service

These Terms of Service (“Terms”) govern your use of ModernMoney, operated by Zach Terflinger (“we,” “us,” or “our”), accessible at modernmoneybudget.com (the “Service”).

By creating an account or using the Service, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them.

ModernMoney is a personal budgeting application that helps you track income, expenses, savings goals, and debt. The Service may optionally connect to your bank accounts through Teller.io to automatically import transactions.

ModernMoney is a budgeting tool only. We are not a bank, financial advisor, or financial institution. Nothing in the Service constitutes financial, investment, tax, or legal advice. All financial decisions remain solely your responsibility.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete information when creating your account
• Notify us immediately of any unauthorized use of your account
• Not share your account with others or allow others to access your account
• Not create multiple accounts for the same person

We reserve the right to suspend or terminate accounts that violate these Terms.

ModernMoney offers optional bank connectivity through Teller.io. By connecting a bank account, you:

• Authorize us to retrieve transaction and balance data from your bank via Teller on your behalf
• Agree to Teller's Terms of Service in addition to these Terms
• Understand that we access your bank data in read-only mode — we cannot move money, initiate transfers, or make changes to your bank accounts
• Acknowledge that bank connectivity may be interrupted due to changes by your bank or Teller, and we are not liable for such interruptions

You may disconnect any bank account at any time from within the app. Upon disconnection, your access token is immediately deleted.

You agree not to use the Service to:

• Violate any applicable law or regulation
• Attempt to gain unauthorized access to the Service or its underlying systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Transmit malware, viruses, or any other malicious code
• Scrape, crawl, or systematically extract data from the Service
• Use the Service for any commercial purpose without our express written permission

The Service, including its design, code, content, and branding, is owned by Zach Terflinger and protected by intellectual property laws. The “ModernMoney” name and logo are proprietary.

You retain ownership of all financial data you enter into the Service. By using the Service, you grant us a limited license to store and process your data solely to provide the Service to you.

ModernMoney is currently in beta. This means:

• The Service is provided free of charge during the beta period
• Features may change, be added, or be removed without notice
• The Service may experience downtime, bugs, or data issues
• We may end the beta at any time, at which point paid plans may be introduced

We will provide reasonable notice before transitioning from a free beta to a paid service.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Transaction data imported from your bank will be complete, accurate, or timely
• The Service will meet your specific requirements
• Any errors in the Service will be corrected

ModernMoney is a budgeting tool, not a financial institution. Your actual bank balances and financial obligations are governed by your bank and applicable law, not by anything displayed in this app.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZACH TERFLINGER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR FINANCIAL LOSSES ARISING FROM:

• Your use of or inability to use the Service
• Any financial decisions made based on information displayed in the Service
• Unauthorized access to your account or data
• Interruptions or errors in bank data syncing

Our total liability to you for any claims arising from use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim (or $0 during the free beta period).

You may delete your account at any time by contacting us at zdterflinger@gmail.com. Upon deletion, your data will be removed within 30 days.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. If we terminate your account without cause, we will provide reasonable notice.

We may update these Terms from time to time. We will notify you of material changes by email or by a notice within the app at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service will be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
